  • Tax Civil Review – In the case that that the Taxpayers receive an unfavorable Appeal or Lawsuit Decision from the Tax Court, we can assist in filing Civil Review Petition to the Supreme Court for reconsideration.
  • Tax Appeal & Lawsuit – After the Objection Decision has been issued by the Regional Tax Office, the next process is the Appeal Process in the Tax Court. In the case that the Tax Office issues a decision other than an Objection Decision, the taxpayer can file a lawsuit to the Tax Court. We can represent the Taxpayers as their Legal Counsel in the Tax Court.
  • Tax Objection – If the Taxpayers disagree with the Tax Assessment Letters as the result from a Tax Audit, the Taxpayer can file for objection to the Regional Tax Office. The Regional Tax Office will issue an Objection Decision which will accept or reject the Taxpayer’s objection.
  • Tax Audit – During a Tax Audit, we are available for a private consultation. We can also assist the Taxpayers in handling Tax Audit properly. We can discuss and explain the Taxpayer’s stance with reasonable legal and technical arguments along with relevant supporting documents to the Tax Auditors.
  • Tax Refund – In an overpayment position (Income Tax & VAT), the Taxpayers can file for a restitution to the Tax Office. The Taxpayers will subject to Tax Audit. We can represent, provide advise, and assist the Taxpayers to prepare necessary documentations for the Tax Auditors and State Treasury. We work until the refund has been made.
  • Merger & Acquisition and Corporate Restructuring – Corporate taxpayers may need to undertake corporate restructuring to minimize tax exposures, maximize tax savings, and comply with the prevailing tax and legal regulations. Efficient and early tax planning can add value in a transaction by reducing both actual transaction tax costs and long-term sustainable tax rates.

In particular, on the corporate commercial side, Mr. Soeratman advised a Singaporean company which has Indonesian subsidiaries and operation on a listing at the Singapore Exchange (SGX), and performed corporate restructuring over the Indonesian entities to comply with SGX’s requirements whereupon the listing was eventually concluded. He assisted a state-owned enterprise which focuses on finance in its role as an arranger to invest a government investment in another state-owned enterprise for the purpose of a national economic recovery program (program pemulihan ekonomi nasional). He had represented a German-based Meeting, Incentive, Convention and Exhibition (MICE) operators in a long-term operation deal for the MICE facility now known as the Indonesia Convention Exhibition (ICE), located in BSD City, Tangerang, Indonesia, whereby he assisted in establishing a foreign direct investment company for the operator to run its business in Indonesia. He also regularly advises clients concerning corporate law, capital market transactions, listing requirements, insurance practices, foreign investments, and joint ventures.

From the labor and employment practice, he assisted and represented clients, among other, several fast-moving consumer goods manufacturing and tobacco company(ies) in their employment matters, reorganization attempts, outsourcing, and employment termination matters, accompanied with preparing and negotiating their collective labor agreements with their company’s labor unions, as well as assisting them in their industrial relation disputes through bipartite, tripartite and labor court phases.

He also practiced a certain degree of commercial litigation, whereby he assisted several clients in their criminal defense concerning allegations in the phases of examination and investigation concerning corruption and or absence of business licenses.

E.L. Sajogo, S.H., MCIArb. graduated from the University of Surabaya and joined Markus Sajogo & Associates (“MS&A”) in 1998. Yudianta Medio Simbolon

Founded Simbolon & Partners Law Firm after his departure from one of Indonesia’s fast growing law firm, obtained his law degree from Padjadjaran University, Bandung. He is a holder of a postgraduate degree from the Gadjahmada University, Yogyakarta. Mr. Simbolon is a member of the Indonesian Bar Association and holds a license to practice in Indonesian Courts, Registered Capital Market Legal Consultant, Intellectual Property Consultant and he is also member of several law organizations international.

Before opening Simbolon & Partners, to complete his experiences and expertise, Mr. Simbolon joined the Indonesian Bank Restructuring Agency (IBRA). In this agency, Mr Simbolon has faced various types of legal matters with respect to the bank recapitalizations and asset resolutions. Oscar Sagita is our Partner and head of Bankruptcy & Restructuring Department. Prior to joining Law Firm LUCAS, S.H. & PARTNERS, Oscar Sagita had worked in several law firms in Jakarta focusing on Bankruptcy cases. He acted as the Creditor on Suspension of Payment (PKPU) for a well known textile and insurance company. Moreover, Oscar Sagita was one of the attorneys in the case involving Central Bank Liquidating Aid.

Currently his area of practice revolves around Civil & Commercial Litigation, Bankruptcy & Restructuring and Criminal Law. Oscar Sagita is a licensed Receiver and Administrator and currently serves as vice of secretary general I of Indonesian Receiver and Administrator Association. Yozua Makes
