2025 was a year of upheaval for foreign businesses sponsoring workers to come to the UK following the publication of a white paper in May. Although the changes made do not directly impact the UK Sponsor Licence, they change the ways that some visas requiring sponsorship function. Other rules more directly impacting the sponsorship progress began in July 2025.
If you are hiring a foreign worker, you will often need to grant them sponsorship. Get help from immigration solicitors like Immigration Advice Service for help with the UK Sponsor Licence application process.
Changes to the Sponsorship Process
The most drastic change made in July 2025 was to the cooling-off period. This is the amount of time a company must wait before reapplying for a sponsorship licence if its licence is revoked. A standard 12-month period still applies, but there is a longer 24-month wait in the following circumstances:
- The employer has had its licence revoked on more than one occasion.
- The employer’s senior staff have held a ‘Key Personnel’ role at multiple firms that have had a sponsor licence revoked or one business that has had it revoked multiple times.
- The employer wants to add one of its branches to the sponsor licence if said branch has had its sponsor licence revoked more than once.
Other changes had already begun to the sponsorship process before July 2025. Most notably, companies were banned from passing on the high costs of obtaining a sponsor licence and certificates of sponsorship to their foreign hires. Companies found to be doing this risked having their sponsor licence revoked.
Restrictions have also tightened significantly for the health and social care sector. Sponsors will now need to maintain records more rigorously, ensuring that they show evidence that the care worker was legally working for them for at least three months before sponsorship. This includes copies of valid right-to-work documents.
These changes are in place. Businesses must comply immediately or risk having their sponsor licence revoked.
What the Immigration White Paper Proposes
Businesses hiring foreign workers should also have an eye on the government’s immigration white paper, published in May last year, even though it doesn’t directly impact the sponsorship process. The white paper makes eight central proposals. Many suggested changes aren’t relevant to businesses hiring foreign workers. An example is introducing tougher rules for universities enrolling international students.
There are three changes directly impacting the workers you sponsor. The first is for sponsoring workers for a Skilled Worker visa. Medium-skilled roles, defined as RQF levels 3-5, will no longer be eligible. If you still need to hire such workers, your industry will need to obtain an exemption from the Migration Advisory Committee and demonstrate its efforts to hire domestically.
Secondly, the white paper proposes stricter English language rules for most visas. This will also be applied to your foreign workers’ family members coming to the UK on a Dependent visa. As a result, the pool in the international labour market will shrink to those with the best English language capabilities, with family members who share such skills.
The final noteworthy change is that the standard qualifying period of indefinite leave to remain will go from five years to ten years. That will increase the amount of time that you need to be sponsoring workers for, requiring a valid sponsor licence throughout. It could also make it harder to convince prospective foreign hires that they can start a permanent life in the UK.
When Will the Changes Come in?
A white paper lists proposals that could come in, rather than bringing the changes immediately into law. As a result, the timetable for the changes remains unclear.
Some changes have already been brought into effect, including the following:
- 22 July 2025: reduction in roles eligible for Skilled Worker visa sponsorship.
- 8 January 2026: stricter English language requirements.
Other changes have general plans for when they might be brought into effect. For example, the increase in the qualifying period for permanent residence should begin from April 2026.
What Does All This Mean for the Sponsor Licence?
The proposed changes don’t change anything about the exact way that your business will obtain sponsor licences and distribute certificates of sponsorship. However, the changes to the sponsorship process detailed at the start of this article will mean that your workers dealing with sponsorships will need to show much greater rigour.
The changes will also make sponsorship even harder for businesses that have previously made errors in their sponsorship of foreign workers. They make it even more essential to maintain compliance, or you risk being restricted to the domestic labour force.
The changes proposed by the white paper are even less connected to the sponsorship process, but they are still profoundly relevant. Amid the restrictions, it will be harder to persuade prospective foreign employees to come to the UK. You’ll now need to work incredibly hard to make a compelling case for coming to the country. Many businesses will consider this not worth the effort.
Sponsor Licence Application Process
You will need to apply for a sponsor licence for your business online via the UK Government website. Follow the steps listed below:
- Confirm that your business will be eligible.
- Select a Worker or Temporary Worker sponsor licence depending on which is more relevant for your business. You can also apply for both categories.
- Appoint the key personnel who will be managing your business’s sponsorship of foreign workers.
- Prepare your supporting documentation and complete the online application form. Supporting evidence needs to be submitted within five days of completing the application form.
- Pay the correct application fee depending on if your business is small, medium, large, or a charity.
Your business may also need to deal with additional checks from UK Visas and Immigration. They may visit your business’s premises to conduct compliance checks. Once your business has been granted a sponsor licence, you’ll need to set up accounts for your relevant staff members on the Sponsor Management System (SMS) online portal. This ensures that your business is compliant from day one.
