Brian S. Faughnan

Brian S. Faughnan is a sole practitioner and the owner of Faughnan Law, PLLC, based in Memphis, Tennessee. Prior to founding his firm, he spent twenty-three years practicing law in large and mid-sized full-service law firms. His work includes business litigation and appellate litigation, with a significant focus on solving problems for lawyers.

Over the years, he has represented hundreds of lawyers and law firms. This representation has included disciplinary matters, litigation, and consulting on issues involving professional liability. He has also served as an expert witness in various matters in both federal and state courts in Tennessee.

He has been recognized in The Best Lawyers in America for Appellate Law since 2009, for Litigation – First Amendment since 2011, and for Ethics and Professional Responsibility Law since 2019. He is listed as a “Super Lawyer” by Mid-South Super Lawyers and holds an AV rating from Martindale-Hubbell. In 2017, he was named Best Lawyers’ Appellate Practice “Lawyer of the Year” in Memphis.

He served as Chair of the Tennessee Bar Association’s Standing Committee on Ethics and Professional Responsibility for thirteen years, stepping down in 2022, and is a past member of the TBA’s Board of Governors. He is also a former President of the Association of Professional Responsibility Lawyers and currently serves on the ABA Standing Committee on Ethics and Professional Responsibility.
