Our practice group has a great deal of experience representing individuals, employers and institutions involving claims of sexual abuse. These cases involve issues such as (1) negligent hiring, retention and supervision (2) assumption of risk (consent) per TATE (3) Temporary care, custody and control (4) statute of limitations (5) standard of care (6) athlete / coach power dynamic (7) PTSD (8) grooming and many others. These cases can be difficult and often require a unique strategy to bring about a favorable resolution.

Defamation cases are strongly guided and often determined by the MPJI (Maryland Pattern Jury Instructions). A plaintiff must initially prove that a statement is defamatory meaning it is likely to cause public scorn and one’s reputation has been damaged. Even if a plaintiff carries this burden he then has the additional burden of proof that the defendant knew the statement was false and was made with intent to deceive. This question is called a conditional privilege and this protects a defendant from making a defamatory statement. In the event a defendant accuses a plaintiff falsely of committing a crime then damages are presumed and this could lead to punitive damages but the burden is very high for a plaintiff.
