Gene C. Colman

Personal: As a father of seven children, and grandfather to many, I realize how essential it is for children to have significant contact and input from both parents. A divorce should not mean that one parent becomes cut off from the children.

Multi Jurisdiction: Divorces and other family law cases that involve more than one jurisdiction is an area of practice where our firm has experience.  I discuss issues with Ontario and international aspects here.

Child Abduction: Where child abduction between counties is an issue, one must consider The Hague Convention of 25 October 1980 on the Civil Aspects of International Child Abduction is a multilateral treaty that establishes proceedings for the prompt return of children who have been wrongfully removed or kept away from their home country.  Canada is a signatory to this Convention along with many other states.  But some countries have not adhered to the Convention, and we have experience there as well.

Residence: Some international family law matters involve complex issues of residence, and one must consider which property regime is to be properly applied and if there is an arguable choice of jurisdiction issue, then your Canadian lawyer must be able to work well with the lawyer in the other country to first of all determine where the client is best off.

Two levels of government in Canada: In Canada, family law jurisdiction is divided between the federal government and the provincial and territorial governments.  For my firm to be involved, your case must have a connection to Ontario.  My firm handles cases throughout the province.

Practice Focus: I have for years advocated:

  • against gender inequality;
  • against parental alienation (resist / refuse);
  • against procedural unfairness; and,
  • on behalf of a legislated presumption for Equal Shared Parenting.

After more than 44 years as a family law lawyer, I find that I do best for clients who have challenging situations of fact and/or law. I welcome complex cases, particularly meritorious appeals on points of law.

Demonstrated Commitment: In September 2018, I was named as the FDRIO (Family Dispute Resolution Institute of Ontario) member of the month.  I have been front and centre in the campaign to improve access to family law justice in Ontario during and post Covid.  I am a founding member of Lawyers for Shared Parenting.  I am a founding editor of the Canadian Journal of Family Law.

Rainier Mamangun

Leaders in Law endorses Rainier Mamangun as our exclusively recommended Family Law expert in the Philippines. If you wish to get in touch with Rainier, please use the contact information provided above.

Atty. Rainier Mamangun’s expertise in family law and domestic relations covers representation and advisory services in annulment, declaration of nullity of marriage, recognition of foreign divorce, child custody, spousal and child support, adoption, and domestic abuse cases, among others. For almost two decades, he has worked on over 200 family law-related cases.

Atty. Rainier R. Mamangun is adept at handling cases in and out of court. His training with the Philippine Department of Foreign Affairs enabled him to hone his diplomatic skills which now prove crucial in his dealings and negotiations with the court and the opposition. His skills at legal drafting and the defense of existing legislation were developed through years of service at the Office for Migrant Workers Affairs and in appearances at Congressional hearings and various inter-agency meetings that dealt with law and policy formulation relating to the welfare of Filipinos overseas. He had defended the constitutionality of the “Migrant Workers’ Act” before the Court of Appeals in coordination with the Office of the Solicitor General.

Prior to establishing the Firm in 2004, Atty. Rainier Mamangun was a lawyer for the Department of Foreign Affairs (DFA) where he worked on labor, civil, and criminal cases involving migrant workers and overseas Filipinos in distress in coordination with Philippine Embassies and Consulates across the globe. He spearheaded various missions to Malaysia, Indonesia, East Timor, Nepal, India and Saudi Arabia to protect the interest of the OFW (Overseas Filipino Worker) ; undertook diplomatic representations with foreign governments in connection with the cases he handled, and appeared before foreign courts such as the Riyadh Grand Court – a rarity for Filipino lawyers. While at the DFA, he was instrumental in the rescue of countless victims of human smuggling and trafficking in Asia, and in saving Filipinos on death row in the Middle East.

In 2003, he was part of the Drafting Committee for the Magna Carta for Seafarers, a bill intended to promote the welfare of millions of Filipino seafarers worldwide. He also briefly worked at the Prosecution Division of the Department of Interior and Local Government (DILG). He has made promising efforts in advocating the rule of law, furthering principles of constitutionalism and strengthening legal profession.

Firm Description:

In Afghanistan provision of legal services trace back to as early as 1964 when the then Afghan Constitution for the first time stipulated the right to defense counsel. However, the profession suffered a setback in the years to come as the entire justice system was heavily affected by different phases of war from late 1970s to 1990s. Contrary to this backdrop, post-2001 with the advent of the international community, a vigorous campaign was initiated to improve the legal sector and strengthen the rule of law in Afghanistan. This has transformed the justice sector immensely and strengthened the legal institutions to a noteworthy level. SHAJJAN & ASSOCIATES remained an essential contributor to this campaign since it was founded.

SHAJJAN & ASSOCIATES was founded in 2011 by Saeeq Shajjan and registered under the laws of Afghanistan. Soon SHAJJAN & ASSOCIATES established itself as a ‘go-to law firm’ in Afghanistan. The firm’s scope of practice includes but is not limited to legal counseling, litigation, legislative drafting and legal capacity building. Additionally, provision of pro-bono legal services to the needy people is inherited as a core culture in each of our attorneys. Client service is our shared professional value. We believe that SHAJJAN & ASSOCIATES is not about us; it is about services to our clients. This attitude helped us to emerge as the ‘firm of choice’ in Afghanistan and beyond.

Mary Barton

Wide ranging experience in international private and public law family issues.  I specialise in all matters where issues arise out of ‘family’ relationships, such as:

Breakdown of relationships, separation and divorce as well as cross-border, residence and contact disputes in relation to children and finance and property issues.

I also help couples looking to prevent difficulties arising in the future by entering into Nuptial Agreements.

I have the experience to not only litigate in the appropriate forum but to also utilise Collaborative Law principles and offer mediation as an alternative.  It is essential to remember that reaching agreement always works best, rather than enduring the additional emotional distress and financial expense of litigation.

Formerly based in London and Essex, latterly in the United Arab Emirates (Dubai) and now in Bulgaria I have  a global client base.  Not only do I have extensive  experience of representing individuals before Courts, but I also have extensive experience as an individual party’s appointed expert witness and as a single joint expert witness, providing written reports or Affidavits and giving oral evidence to Courts in various jurisdictions.  My experience and expertise in UAE (Dubai, Abu Dhabi etc) family law, is recognised at The Academy of Experts, London and in my accreditation as a Member of that body.

I am an energetic parent and grand-parent who came to the legal profession ‘by accident’. In 1992 I graduated from the impressive Law Department of The University of Essex, where my tutors included the late Professor Sir Nigel Rodley, Professor Dame Carolyn Hamilton and Professor Francoise Hampson (to name but a few). I then worked as a Paralegal with a local law firm in Essex until my youngest child reached an age where I could travel to complete the Academic Stage of my training, which I did in 1997. After completion of my Solicitor’s Training Contract in London (and taking numerous further examinations to complete my post-graduate Diploma in Legal Practice) I was admitted to the Roll of Solicitors on 1 February 2000.
